Government publishes contract amendments consultation
The Government has today opened a consultation seeking views on drafting amendments to the Contracts for Difference (CfD) Standard Terms and Conditions and the Private Network (PN) CfD Agreement.
The proposed amendments will apply to the Standard Terms and Conditions and the PN CfD Agreement for the sixth Allocation Round, which is scheduled to open in March 2024.
The proposed amendments aim to:
- streamline Know Your Customer checks to ensure that generators provide relevant information to the Low Carbon Contracts Company, the CfD Counterparty, when required
- amend the PN CfD Agreement to make generators that directly supply offshore installations ineligible for that Agreement, implementing the government’s previous decision on this matter.
- adjust the Change Control Procedure in Annex 2 of the Standard Terms and Conditions to introduce a revised threshold to trigger a Classification Objection dispute
- Update the definition of Milestone Delivery Date (MDD) to accommodate extensions to the MDD in the event of delays relating to the mitigation of windfarm interference with air defence radar.
The consultation also invites views on how the current 18-month MDD has been operating in practice to ascertain whether any amendments might be needed for future allocation rounds.
The consultation closes on 30 January 2024.
